Attorney Larry Zhou Represented a Nepali Client in Reaching a Settlement with a Chinese Insurance Company Regarding a Cargo Insurance Dispute, Successfully Secured Compensation

Recently, Larry Zhou, a senior partner from Landing (Shenzhen) Law Office, along with intern lawyer Jeremy Hu, successfully resolved a long-standing international trade insurance claim dispute for a Nepali client, helping the client recover the insurance compensation that was denied due to cargo loss.


Represented a Nepali Client in Reaching a Settlement

In 2019, the Nepali client imported a batch of range hoods and other goods from China and purchased cargo transportation insurance from a Chinese insurance company. Before the goods were delivered to the client, a loss occurred, and the client filed a claim with the insurance company. However, the insurance company denied the claim, stating that the loss was not covered. After several unsuccessful negotiations, the client decided to seek help from Landing (Shenzhen) Law Office.


After reviewing the case materials, Larry Zhou's team believed that although the statute of limitations had expired by one year, the insurance company’s denial of the claim was unreasonable at that time, and there was still a possibility of obtaining compensation through negotiations with the insurance company. Larry Zhou's team initially communicated with the insurance company, but negotiations stalled due to changes in the company's personnel over the years. Faced with this challenge, Larry Zhou's team took decisive action by reporting the situation to the relevant regulatory authorities and seeking assistance, requesting the insurance company to provide specific reasons and basis for the denial.


While negotiating with the insurance company, Larry Zhou's team filed a lawsuit on behalf of the client in the maritime court located in the insurance company's jurisdiction. During the litigation process, Larry Zhou's team encountered difficulties with the Nepali consulate not being able to notarize the client’s power of attorney. To tackle this thorny issue, Larry Zhou's team communicated with the local consulate and court, providing relevant cases and evidence, which ultimately led to the successful acceptance of the case by the court. After the case was filed, both parties reached a settlement under the court's mediation, and the Nepalese client successfully obtained compensation from the insurance company.
